1. Acceptance of terms
Welcome to AgroBridge. These Terms of Service (“Terms”) govern your access to and use of the AgroBridge mobile application, website, and related services (together, the “Platform”), operated by AgroBridge Zambia (“AgroBridge”, “we”, “us”, or “our”).
By creating an account, or by accessing or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.
2. Eligibility & accounts
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using AgroBridge you represent that you meet these requirements.
Registration
Accounts are created and verified using your mobile phone number. A single account may be used to both buy and sell — you can switch between Buyer and Seller modes at any time.
Account security
You are responsible for keeping your phone number, verification codes, and account secure, and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
3. Our role in the marketplace
AgroBridge is a venue that connects Buyers and Sellers. We are not a party to any transaction between users and we do not buy, sell, own, inspect, or take possession of any item listed on the Platform.
Any contract for the sale of produce or equipment is formed directly between the Buyer and the Seller. AgroBridge is not responsible for the quality, safety, legality, or delivery of listed items, or for the ability of users to complete a transaction.
We do not guarantee that any listing, offer, or user is accurate, genuine, or reliable. You transact with other users at your own risk and should use your own judgement.
4. Listings & seller obligations
If you list an item as a Seller, you agree that:
- You have the legal right to sell the item and it is accurately described, including its category, quantity, price, unit, and condition.
- Prices you set (retail and any bulk pricing) are genuine and honoured for the stated quantities.
- You will keep stock and availability up to date and remove or restock Listings as needed.
- You will fulfil confirmed Orders through the pickup or delivery method you offer.
- Your Listings comply with all applicable Zambian laws and these Terms.
We may remove any Listing, at our discretion, that we believe violates these Terms or applicable law.
5. Offers, negotiation & orders
Buyers may accept a Seller’s listed price or send an offer. Sellers may accept, decline, or counter that offer. A negotiation continues until one side accepts or the offer is withdrawn or expires.
When an offer is accepted, an Order is created between the Buyer and the Seller on the agreed price, quantity, and collection method. Both users are expected to honour accepted Orders. Repeatedly abandoning agreed Orders may lead to restrictions on your account.
6. Prices, payment & fees
All prices are set by Sellers and displayed in Zambian Kwacha (ZMW) unless stated otherwise. Sellers are responsible for the accuracy of their prices and for any taxes or duties that apply to their sales.
Payment is made directly between the Buyer and the Seller on collection or delivery, using the method the two of you agree. AgroBridge does not hold, process, or escrow funds, and is not responsible for any payment made or missed.
Use of the Platform is currently free for Buyers and Sellers. If we introduce fees for any feature, we will tell you before those fees apply to you.
7. Collection & delivery
Sellers state whether an item is available for pickup, delivery, or both, along with any delivery area or charge. The Buyer and Seller are responsible for agreeing a time, place, and method of handover.
Please take sensible precautions when meeting another user: meet in a public or known location where possible, inspect goods before paying, and do not share verification codes with anyone.
8. Cancellations & disputes
Either party may cancel an Order before handover by notifying the other through the Platform. Once goods have been collected and paid for, any return, replacement, or refund is a matter between the Buyer and the Seller.
We encourage users to resolve disputes directly. You may report a problem to us and we may, at our discretion, review activity, share relevant records, or restrict accounts — but we are not obliged to mediate or resolve disputes between users.
9. Prohibited items & conduct
You may not use the Platform to:
- List or sell anything you are not legally allowed to sell, including stolen, counterfeit, or restricted goods.
- List agricultural chemicals, veterinary medicines, seed, or equipment in breach of Zambian licensing or safety requirements.
- Post false, misleading, or fraudulent Listings, offers, prices, or reviews.
- Harass, threaten, defraud, or discriminate against other users, or collect their personal information for unrelated purposes.
- Interfere with the Platform, attempt to gain unauthorised access to it, or scrape it by automated means.
- Take negotiations off the Platform in order to evade these Terms or any safety measure.
10. Your content
You keep ownership of the photos, descriptions, and other content you upload. By posting content you grant AgroBridge a non-exclusive, royalty-free licence to host, display, and reproduce it for the purpose of operating and promoting the Platform.
You are responsible for the content you post and confirm you have the rights to it. We may remove content that breaches these Terms or the rights of others.
11. Privacy
Our Privacy Policy explains what personal information we collect and how we use it, including the location data we use to show you Listings near you. By using the Platform you consent to that handling of your information.
12. Suspension & termination
You may stop using the Platform and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms, create risk for other users, or where we are required to do so by law.
Terminating your account does not affect Orders you have already agreed or obligations you have already incurred to other users.
13. Disclaimers
The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind about the Platform, its availability, or any Listing, user, or transaction on it.
Distances, ratings, and search results are indicative only and should not be relied on as a guarantee of location, quality, or reliability.
14. Limitation of liability
To the fullest extent permitted by Zambian law, AgroBridge is not liable for any indirect or consequential loss, or for loss of profit, produce, crops, income, or data, arising from your use of the Platform or from any dealing with another user.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify AgroBridge against claims, losses, and costs arising from your Listings, your transactions with other users, or your breach of these Terms or of applicable law.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where the change is significant, give notice in the app. Continuing to use the Platform after a change means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the Republic of Zambia, and the courts of Zambia have jurisdiction over any dispute arising from them or from your use of the Platform.
